1. Acceptance of Terms
By accessing or using TheraTouch+ ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform. These terms apply to all users, including patients, therapists, and administrators.
2. Description of Service
TheraTouch+ is a HIPAA-compliant healthcare technology platform that connects patients with licensed mental health professionals. The Platform provides scheduling, secure messaging, session documentation, and practice management tools. TheraTouch+ is a technology platform and does not provide medical advice, diagnosis, or treatment.
3. Eligibility
- Patients: Must be at least 18 years of age, or have parental/guardian consent if a minor.
- Therapists: Must hold a valid, active license to practice in their jurisdiction. Credentials are subject to verification by our administrative team.
- All users must provide accurate and complete registration information.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You must:
- Use a strong password (minimum 12 characters) and keep it confidential
- Enable two-factor authentication when required
- Notify us immediately of any unauthorized access to your account
- Not share your account credentials with any other person
- Keep your contact information current and accurate
5. HIPAA Compliance
All users must acknowledge and consent to our HIPAA Privacy Practices before using the Platform. By using TheraTouch+, you agree to:
- Use the Platform in compliance with HIPAA regulations
- Not share or disclose Protected Health Information outside the Platform
- Report any suspected security incidents or breaches immediately
- Log out of your account after each session and not share devices without proper safeguards
6. Therapist Responsibilities
Therapists using the Platform agree to:
- Maintain a valid and active professional license at all times
- Provide accurate credential information and notify us of any changes
- Complete session documentation in a timely manner
- Adhere to their profession's code of ethics and standards of practice
- Manage their availability accurately to prevent scheduling conflicts
- Respond to patient communications within a reasonable timeframe
7. Patient Responsibilities
Patients using the Platform agree to:
- Provide accurate health and personal information
- Attend scheduled appointments or cancel with at least 24 hours notice
- Use the messaging feature for clinical communication only
- Not use the Platform as a substitute for emergency mental health services
8. Appointments and Cancellations
- Appointments are confirmed upon booking and a confirmation notice is sent to both parties.
- Cancellations must be made at least 24 hours before the scheduled appointment time.
- Late cancellations may be subject to the therapist's cancellation policy.
- Repeated no-shows may result in account restrictions.
9. Fees and Payment
- Patient accounts are free to create and use.
- Therapist subscriptions are billed monthly at the current published rate.
- Enterprise plans are billed per a custom agreement.
- Session fees are arranged directly between patients and therapists.
- Subscriptions may be cancelled at any time; access continues until the end of the billing period.
10. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose
- Attempt to access another user's account or data
- Transmit malware, viruses, or other harmful code
- Interfere with the Platform's security features or infrastructure
- Scrape, harvest, or collect user data from the Platform
- Impersonate another person or misrepresent your credentials
- Use the Platform for spam, harassment, or abusive behavior
11. Intellectual Property
The Platform, including its design, features, code, and content (excluding user-generated content), is the intellectual property of TheraTouch+ Inc. Users retain ownership of their own content but grant us a limited license to store, display, and process it as necessary to provide our services.
12. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THERATOUCH+ INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
14. Termination
We may suspend or terminate your account if you violate these Terms. Upon termination, your access to the Platform will cease, but data will be retained as required by HIPAA regulations. You may request account deactivation at any time by contacting support.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Any disputes will be resolved in the federal or state courts located in San Francisco County, California.
16. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or platform notification at least 30 days in advance. Continued use after changes take effect constitutes acceptance.
